These Terms of Service (“Terms”) govern your access to and use of the Latch & Lash website and services (the “Site”). By visiting or purchasing from the Site, you agree to these Terms and our Privacy Policy and Refunds & Returns Policy.

Note: Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

1) Who we are

2) Eligibility & your account

•You must be at least the age of majority in your jurisdiction to use the Site or make a purchase.

•Keep your account credentials secure. You’re responsible for activity on your account.

3) Products, pricing & availability

•We try to display product information accurately, but colors and details may vary by device.

•Prices are shown in the currency indicated at checkout and may change without notice.

•We may limit or cancel quantities per order, per person, or per address.

•If a product is unavailable or an error is found (including pricing), we may cancel all or part of your order and refund you.

4) Orders & payment

•When you place an order, you’re offering to buy the products listed. We accept your offer when we send an order confirmation email.

•We accept the payment methods shown at checkout. You authorise us (and our payment provider) to charge your selected method.

•You must provide current, accurate billing, shipping and contact details.

•Taxes and shipping fees (if any) are shown at checkout.

5) Shipping, risk & title

•We ship to the destinations listed at checkout. Delivery estimates are not guarantees.

•Risk of loss passes to you upon delivery to the address you provide; title passes upon our receipt of full payment.

6) Returns, exchanges & refunds

•For faulty or misdescribed items, your ACL rights apply. Contact latchandlash@gmail.com with your order number and photos.

7) Personal use; no reselling

•Products are sold for personal, non-commercial use unless we agree otherwise in writing.

8) Promotions, gift cards & discount codes

•Promotions and codes are subject to their specific terms and may change or end without notice.

•Gift cards are non-refundable and not redeemable for cash except where required by law.

9) Subscriptions or recurring charges (if enabled)

•If you enroll in a subscription, you authorise recurring charges at the interval shown until you cancel.

•You may cancel via your account or by contacting us before the next renewal is processed.

10) User content (reviews, photos, messages)

•If you submit content (e.g., reviews, photos), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, publish and display such content for marketing and operational purposes.

•Don’t submit content that is unlawful, infringing, misleading, or harmful. We may remove content at our discretion.

11) Acceptable use

You agree not to:

•Interfere with the Site’s security or operation;

•Use scraping, bots, or automated means without permission;

•Upload malware or harmful code;

•Infringe intellectual property or privacy rights;

•Engage in fraudulent, abusive, or illegal activity.

12) Intellectual property

•The Site, its content, logos, graphics, and design are owned by us or our licensors and protected by IP laws.

•You may not copy, modify, distribute, or create derivative works except as permitted by law or with our written consent.

13) Third-party services & links

14) Warranties & ACL

•To the maximum extent permitted by law, the Site and products are provided “as is” and “as available.”

•ACL carve-out: Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law.

15) Limitation of liability

•To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses; loss of profits; or data loss arising from your use of the Site or products.

•Where liability cannot be excluded under the ACL, our liability is limited to the remedies required by law (e.g., repair, replacement, or refund).

16) Indemnity

•You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or misuse of the Site.

17) Force majeure

•We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, supply chain issues, strikes, outages).

18) Termination

•We may suspend or terminate your access to the Site at any time for any reason, including suspected breach of these Terms. Sections intended to survive termination will survive.

19) Governing law & venue

•These Terms are governed by the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.

20) Changes to these Terms

•We may update these Terms from time to time. The updated version will be posted on the Site with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
